Occasionally, we’ve referenced well-known cases from the media which involve divorce or family law issues. These “celebrity” cases can often shed valuable light on various aspects of the divorce process. Many of these cases, for instance, prominently display the utility of prenuptial agreements. One big case which we haven’t discussed yet is the divorce of Bill and Melinda Gates (nee French).
Bill and Melinda met while Melinda worked as a Microsoft employee. For many years during their marriage, Mr. Gates was listed as the wealthiest individual in the world. The news of the couple’s divorce shocked many around the globe.
Gates Divorce Rested on “Irretrievably Broken” Standard in WA State
Cases need not have anything extraordinary about them in order to provide useful information. In some instances, “mundane” cases can be just as useful as outlandish ones. Both procedurally and substantively, the Gates divorce was rather mundane, as Melinda petitioned on the ground that the marriage was "irretrievably broken.” Melinda filed in the State of Washington, the home state of Mr. Gates.
Like Maryland, Washington is also a no fault state, but the requirements for obtaining a faultless divorce are a bit different. In Washington, the petitioner cites the marriage as being irretrievably broken (or as having “irreconcilable differences”), and then the mandatory cooling off period must be observed. Maryland operates differently, as the petitioner needs to show that the conditions of voluntary separation have been met. In Maryland, there must be physical separation for at least 12 months, no cohabitation during this period, and there must be no hope of reconciliation.
Certainly, the most extraordinary aspect of this case are the figures involved in the property division phase. Given the vast wealth of the couple, dividing the marital estate was a daunting task. Simply documenting all the wealth in the marital estate must have been an immense challenge. Mrs. Gates immediately became one of the wealthiest individuals in the country.
Allegations of Infidelity Against Mr. Gates
As mentioned, the Gates divorce was relatively unspectacular in essentially all procedural and substantive respects. However, there were a few details which many would consider noteworthy, including the allegations of infidelity against Mr. Gates. These details weren't revealed immediately, but came up gradually during the divorce litigation. There was at least one credible source which claimed that, during the marriage, Mr. Gates had made romantic advances toward a female employee at Microsoft. These advances were substantiated in the form of multiple pieces of electronic communication. Of course, this doesn’t make the Gates divorce unusual necessarily, it’s just a detail which most among the general public would consider noteworthy.
